Terms of Service

By accessing or using the FlowForge Labs website (flowforgelabs.in) and our SaaS products, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

These terms are governed by the Information Technology Act, 2000, the Consumer Protection Act, 2019, and other applicable laws of India.

FlowForge Labs designs and builds custom AI-powered systems for businesses of every size and industry. Our services include conversational AI bots, workflow automation, intelligent dashboards, document generation, and end-to-end business process automation — delivered as SaaS products tailored to specific industry verticals.

• You are responsible for maintaining the confidentiality of your account credentials.
• You must provide accurate and complete information when creating an account.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorised use of your account.
• We reserve the right to suspend or terminate accounts that violate these terms.

You agree not to:

• Use our services for any unlawful purpose or in violation of any applicable Indian laws
• Attempt to gain unauthorised access to our systems or other users' accounts
• Interfere with or disrupt the integrity or performance of our services
• Upload or transmit malicious code, viruses, or any harmful content
• Reproduce, duplicate, or resell any part of our services without written permission
• Use our services to process, store, or transmit data in violation of the DPDP Act 2023

Our services follow a pricing model comprising a one-time setup fee and a recurring monthly subscription. The setup fee covers initial system configuration, integration, and onboarding.

You retain full ownership of all data you input into our products. We do not claim any ownership rights over your business data, client information, or any content you create using our services.

Upon termination of your subscription, you may request an export of your data in a standard, machine-readable format. The export format and wind-down timeline are agreed during termination. After the agreed wind-down period, your data is permanently deleted from our active systems.

We strive to maintain high uptime for our services. However, we do not guarantee uninterrupted availability and are not liable for any downtime or service interruptions caused by:

• Scheduled maintenance (with reasonable prior notice)
• Third-party service outages beyond our control
• Force majeure events
• Actions by government or regulatory authorities

All content, trademarks, logos, software, and intellectual property displayed on our website and within our products are owned by FlowForge Labs or its licensors. You may not use, reproduce, or distribute any of our intellectual property without prior written consent.

Your use of our SaaS products is governed by the End-User License Agreement (EULA).

To the maximum extent permitted by Indian law, FlowForge Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to loss of data, revenue, or business opportunities.

Our total cumulative liability in connection with these terms shall not exceed the total fees paid by you to FlowForge Labs in the twelve (12) months preceding the event giving rise to the claim.

You agree to indemnify and hold harmless FlowForge Labs, its founder, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of our services, your violation of these terms, or your infringement of any third-party rights.

We may suspend or terminate your access to our services if you breach these terms, with reasonable notice where practicable. You may cancel your subscription at any time as per the Refund & Cancellation Policy.

Upon termination, your right to use our services ceases immediately. Sections relating to intellectual property, limitation of liability, indemnification, and governing law survive termination.

These Terms shall be governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000, the Consumer Protection Act, 2019, and the Digital Personal Data Protection Act, 2023.

Any disputes arising from these terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within thirty (30) days, disputes shall be subject to arbitration in accordance with the Arbitration and Conciliation Act, 1996, with the seat of arbitration in New Delhi, India.

The courts of New Delhi, India shall have exclusive jurisdiction over any disputes not resolved through arbitration.

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. For material changes, we will provide at least 30 days' notice via email or a prominent notice on our website. Continued use of our services after the effective date constitutes acceptance of the revised terms.

Nothing in these Terms creates a partnership, joint venture, agency, equity interest, co-founder relationship, or employment relationship between FlowForge Labs and the customer. The customer is a paying user of a software service; no other relationship is implied or created by its use of our website, products, or any commercial interaction with FlowForge Labs or its founder.

FlowForge Labs does not raise capital from its customers and does not issue equity, revenue shares, or referral commissions as a condition of any customer relationship. Any early-access, design partner, or credits arrangement is a paid commercial agreement governed by a separate written service agreement.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
